How do you get Power of Attorney over a family member with a mental illness who is uncooperative? - new jersey power of attorney form
The father of my friend lives with us. He suffers from bipolar disorder, mild Parkinson's disease and depression. He receives a monthly check S.SI. (I think that is what it is, because it is) 63. He makes bad decisions with the money you receive each month (he tested for a month to repair the car but not your choice), he lives with us in first place (which may make himself, his own account the bad financial decisions made live). It is usually once or twice in the hospital a year for depression. My friend asked if he could get help in control of their financial situation, he refused. What you can do to justice to this point? We live in New Jersey. Thank you for your help.

You must ask the court for a guardianship. It is best to contact an attorney who can say what your chances if the circumstances before too much money for him ....
The court is his friend Mentor, which make use of an attorney-in-fact has a different way (denoted by a lawyer). If you are an important financial decisions for him (ie he lives) need to make, should be appointed his guardian.

must be declared unable to prove its very hard to ... Mistakes are not incapable of ... I say throw him in a nursing home ..
All these answers are correct to a certain extent, but you should know that (the United States, any State) may have a different procedure - or any other rule for the same proceedings (for example, what is "incompetent?")
Unfortunately, you really should consult a lawyer - or at least call a of the 800 issues on the agenda, which offers free, but very general, legal advice. You do not want your hat on something hang like Yahoo Answers.
Should be declared incapable by a doctor, you should have no problems to get food. My grandmother has everything that precedes and is the path to take. Good luck and God bless!
Perhaps he did not give her, as a proxy --
Not A - Ensure that your gf will do better then it has
b - not in a position to tell you what your diagnosis
c-money - if you could start with so little, he did not trust him
In addition to talking with a lawyer, maybe you should to your doctor (s). Perhaps more needs treatment, not someone to manage your funds. None of these diagnoses were doing what incompetent or does not know what. Then you probably need to earn your trust first. Why not concentrate out better than their money and their dignity?
